1. Introduction & acceptance
These Terms & Conditions (the “Terms”) govern your access to and use of the websites, trading platforms, applications and related services provided by Trixo Market (“Trixo Market”, “we”, “us” or “our”). By opening an account, accessing our platform, or otherwise using our services, you confirm that you have read, understood and agreed to be bound by these Terms in full.
If you do not agree with any part of these Terms, you must not use our services. We may amend these Terms from time to time; the version published on this website at the time you use our services is the version that applies. Where changes are material, we will take reasonable steps to notify you in advance.
2. Eligibility
To open and operate an account with Trixo Market, you must meet the following minimum requirements:
- You are at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is higher.
- You have the legal capacity to enter into a binding contract and are not subject to any restriction that would prevent you from doing so.
- You are not a resident of, or located in, a jurisdiction in which our services are prohibited or in which we are not authorised to operate.
- You are not acting on behalf of, or for the benefit of, any person or entity subject to applicable sanctions.
We reserve the right to request evidence of your eligibility at any time and to decline or close any account that does not meet these requirements.
3. Account registration
You must provide accurate, current and complete information during registration and keep that information up to date. As part of our onboarding process, and to meet our legal and regulatory obligations, you will be required to complete identity verification and customer due diligence checks before your account is activated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorised access to or use of your account. Each client may hold only one account unless we have agreed otherwise in writing.
4. Services & risk
Trixo Market provides access to trading in a range of financial instruments, which may include leveraged products such as contracts for difference. These products are complex and carry a high level of risk. They may not be suitable for all investors, and you may lose some or all of your invested capital.
Nothing on our platform constitutes investment, tax or legal advice, or a personal recommendation to buy, sell or hold any instrument. Any market commentary, tools, signals or educational material we provide is for general information only. You are solely responsible for evaluating the merits and risks of any transaction in light of your own circumstances. Please review our Risk Disclosure before trading.
5. Client responsibilities
When using our services, you agree that you will:
- Use the platform only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.
- Ensure that funds deposited are your own and derive from legitimate sources.
- Not engage in market abuse, manipulation, arbitrage exploiting pricing errors, or any abusive trading practice.
- Not use any automated system, robot or other device to access the platform in a manner that we have not authorised.
- Maintain sufficient margin to support your open positions and monitor your account regularly.
6. Fees & charges
You agree to pay all spreads, commissions, swap or financing charges, and any other fees applicable to your account and trading activity, as set out in our pricing schedules. Fees may vary by instrument, account type and market conditions, and may change from time to time. Where required, fee changes will be communicated in advance.
You are responsible for any taxes, levies or duties that may apply to your trading activity or profits in your jurisdiction. We do not provide tax advice and recommend that you consult an independent professional adviser.
7. Intellectual property
All content on our websites and platforms — including text, graphics, logos, trademarks, software, layouts and data compilations — is owned by or licensed to Trixo Market and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your personal, non-commercial trading activity.
You may not copy, reproduce, distribute, modify, reverse-engineer or create derivative works from any part of our services without our prior written consent.
8. Limitation of liability
To the fullest extent permitted by applicable law, Trixo Market shall not be liable for any indirect, incidental, special or consequential losses, or for any loss of profit, arising out of or in connection with your use of our services. We do not warrant that the platform will be uninterrupted, error-free or free from delays.
We shall not be responsible for losses resulting from circumstances beyond our reasonable control, including but not limited to interruptions in connectivity, failures of third-party providers, market disruptions, or events of force majeure. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
9. Termination
You may close your account at any time by contacting us, subject to the settlement of any open positions and outstanding obligations. We may suspend or terminate your account, with or without notice, where we reasonably believe you have breached these Terms, where required by law or by the relevant regulatory authorities, or where we cease to offer the relevant service.
Upon termination, you remain liable for any obligations accrued prior to closure, and the provisions of these Terms that by their nature should survive termination will continue to apply.
10. Governing law
These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of the jurisdiction in which the relevant Trixo Market operating entity is established, and are subject to the exclusive jurisdiction of the competent courts of that jurisdiction, except where mandatory consumer protection rules provide otherwise.
